Raskin’s Call to Action
At a press conference alongside former Republican Rep. Joe Walsh, Raskin emphasized the role of Congress in defending constitutional order and preventing abuses of executive power. “It is up to Congress, the representative branch of the people, to defend the constitutional order against presidents who would trample the freedoms of the people,” Raskin stated.
He is spearheading an initiative urging bipartisan support for a “No Dictators Declaration,” aiming to close statutory loopholes that could allow a president to misuse executive power.
The “No Dictators Declaration”
Raskin, backed by the American Civil Liberties Union (ACLU), introduced a five-point pledge targeting presidential overreach. Although Raskin avoided mentioning Trump directly, the pillars address concerns often associated with the former president’s actions:
- Limiting Emergency Powers: Restricting the president’s ability to declare questionable emergencies to bypass Congress.
- Restricting Use of the Insurrection Act: Limiting presidential authority to deploy the military domestically.
- Protecting Civil Service Integrity: Preventing loyalty tests and purges that replace qualified professionals with partisan loyalists.
- Ensuring Accountability: Allowing presidents who commit crimes to be prosecuted, reinforcing that no one is above the law.
- Curbing Abuses of Investigative Powers: Stopping presidents from using prosecutorial powers to target political opponents.
Supreme Court’s Impact and Future Legislation
The Supreme Court’s ruling, which stemmed from Special Counsel Jack Smith’s investigation into Trump’s efforts to overturn the 2020 election, broadened presidential immunity for “official” acts. While Raskin did not rule out potential legislative action, he noted the effort’s success hinges on Democrats regaining a House majority in the upcoming elections.
